2. Regulatory & Clinical Compliance
SGM Medical Esthitics LDA operates in accordance with:

Applicable DGS guidelines and best clinical practices

EU General Data Protection Regulation (GDPR)

Professional and ethical standards applicable to medical and aesthetic healthcare providers
All treatments are performed by qualified and appropriately trained professionals within their legal scope of practice.
3. Scope of Medical Aesthetic Services
SGM provides non-surgical medical aesthetic treatments, which may include consultations, facial and body aesthetic procedures, skin therapies, and other related services.
All treatments are:

Subject to a prior medical consultation

Based on an individual clinical assessment

Performed only when deemed clinically appropriate and safe
SGM reserves the right to refuse, postpone, or discontinue treatment when medical contraindications, safety concerns, or regulatory obligations apply.
4. Medical Consultation & Informed Consent
In line with DGS expectations:

A full medical history must be disclosed by the client prior to treatment

Risks, benefits, alternatives, and potential side effects will be explained

Clients must provide free, informed, and written consent before any medical aesthetic procedure
Consent may be withdrawn at any time prior to treatment.
5. Medical Disclaimer & Treatment Outcomes
All medical aesthetic procedures involve inherent risks and individual variability.
SGM does not guarantee:

Specific aesthetic outcomes
-
Duration of results
-
Complete absence of side effects or complications
By proceeding, the client acknowledges understanding of these risks and accepts that outcomes may vary.
6. Patient Responsibilities
Clients agree to:

Provide accurate, complete, and updated medical information

Follow all pre-treatment and post-treatment instructions
-
Immediately report adverse reactions, complications, or concerns
Failure to comply may affect treatment outcomes and limit SGM’s professional responsibility.
7. Appointments, Cancellations & Delays

Appointments must be booked in advance
-
Cancellations or rescheduling require at least 48 hours’ notice
-
Late cancellations or non-attendance may result in loss of deposits or additional fees
SGM reserves the right to reschedule or cancel appointments for clinical, medical, or operational reasons, including practitioner unavailability or patient safety concerns.
8. Fees, Payments & Pricing

All prices are stated in Euros (€) and include applicable taxes unless otherwise specified

Payment is due at the time of service unless agreed in writing

Prices may be updated without prior notice
Deposits are non-refundable except where required by law.
9. Refund Policy
Due to the personalized and medical nature of treatments:

Completed treatments are non-refundable

Prepaid packages may be partially refunded for unused sessions, subject to administrative review

Refunds are assessed on a case-by-case basis in accordance with Portuguese consumer law
10. Data Protection & Medical Records (GDPR)
SGM Medical Esthitics LDA processes personal and health data in strict compliance with GDPR and Portuguese data protection legislation.
Client data is:

Collected solely for clinical, legal, and administrative purposes

Stored securely and confidentially

Retained only for legally required periods
Clients have the right to access, rectify, restrict, or request erasure of their data where legally applicable.
11. Clinical Photography
Clinical photographs may be taken for:

Medical documentation

Treatment monitoring
Any use for marketing, education, or publication requires explicit, separate written consent, in accordance with GDPR and DGS ethical standards.
12. Adverse Events & Patient Safety
SGM maintains procedures for:

Managing adverse reactions or complications

Clinical follow-up when necessary

Referral to appropriate healthcare services if required
Patient safety is a primary clinical priority.
13. Limitation of Liability
To the fullest extent permitted by Portuguese law:

SGM is not liable for indirect or consequential damages

Liability is limited to the value of the treatment provided
Nothing in these Terms excludes liability for gross negligence, willful misconduct, or violations of mandatory legal obligations.
14. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of Portugal.
Any disputes shall fall under the exclusive jurisdiction of the Portuguese courts.
15. Amendments
SGM Medical Esthitics LDA reserves the right to update these Terms & Conditions at any time to ensure ongoing legal, clinical, and regulatory compliance.
